Acceptance and Use of the Platform

These Terms of Use govern your use of the Orderak website (www.orderak.net) and the Orderak mobile application (the "App"). Collectively, these are referred to as the "Platform." By using the Platform, which includes installing, downloading, or simply accessing the services, you enter into a contract with Orderak and signify your acceptance of these Terms of Use and other Orderak policies such as the Cancellation & Refund Policy and Privacy Policy. These policies are subject to updates, and your continued use of the Platform constitutes acceptance of these changes. The Platform is intended for use by individuals who are at least 18 years old and by corporate entities. Certain provisions of these Terms may be subject to country-specific regulations.

Validation of Agreement

When you use the Platform, including creating an account or accessing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including our Privacy Policy available at Orderak.net. This forms a legally binding contract between you and Orderak. It's essential to read these Terms carefully before using our services.

As a Platform user, you commit to adhering to these Terms. You are also responsible for ensuring that anyone accessing the Platform via your internet connection is aware of and complies with these Terms. Any content you submit or engage with on the Platform implies your agreement to these Terms.

If you disagree with these Terms, you must refrain from using the Platform. Be aware that Orderak reserves the right to modify these Terms without prior notice, and your continued use of the Platform following any changes indicates your acceptance of those modifications.

Our Services

Orderak reserves the right to restrict or limit sales of its Goods to certain individuals, regions, or jurisdictions, in compliance with local laws. We cannot guarantee the quality or law compliance of the Goods, nor can we ensure that the Goods listed will always match those provided to Users.

In cases where Merchants claim their goods meet certain standards (like being organic or allergen-free), Orderak does not independently verify these claims. We advise Users with allergies or dietary restrictions to contact the Merchant directly before placing an order.

While Orderak and its Merchants strive to follow your special instructions for an order, there may be instances where this is not feasible. In such cases, Orderak and the Merchants are not obligated to replace or refund orders that do not adhere to your specified instructions.

Orderak is not liable for any goods or services provided by Merchants that are unsatisfactory or cause harm. Users are responsible for verifying delivery addresses, and Orderak is not liable for errors in these addresses. Note that delivery times may vary due to factors beyond our or the Merchants' control, and we will inform you of any known delays.

Registering for an Account on the Platform

Account Creation and Responsibility

  • To create an account on Orderak, users choose their own unique username and password.
  • Users are solely responsible for maintaining the confidentiality of their password. Orderak is not liable for any issues arising from password use.
  • Users' usernames and passwords may be shared with third-party companies to facilitate service delivery, such as sharing a phone number with a Merchant for delivery purposes.

Logging In

  • Accessing certain services on the Platform requires users to log in with their username and password.

User Information and Conduct

  • Users must provide true, accurate, and complete personal information and promptly update any changes.
  • Impersonation or using false names is prohibited.
  • Users are not allowed to register multiple accounts for themselves. Violations can lead to account termination.
  • Users are responsible for all activities and orders made through their account. If a password breach is suspected, they should immediately contact Orderak.
  • The Platform must not be used for any unlawful activities, including distributing harmful material, breaching laws, disrupting others' use of the Platform, or attempting unauthorized access.

Account Limitations

  • Each device is expected to be associated with only one User account. While multiple accounts per device might be permitted, promotions will not be applicable in these cases.
  • Users can delete their account by contacting Orderak’s customer service.

Ordering and Fulfillment Workflow

Placing an Order

  • After selecting Goods from a Merchant, you can submit your order by clicking "Checkout." It's important to review and correct any errors before submission, as changes cannot be made afterward.

Order Confirmation and Payment Authorization

  • Once an order is received, the Platform begins processing it. You will receive a confirmation message on the final page.
  • If your payment is not authorized, you will be redirected to the previous page, and Orderak is not obligated to provide the services.


Commercial and Contractual Terms

  • Commercial terms like price, taxes, shipping, payment methods, etc., are agreed upon solely between Buyers and Merchants.
  • Orderak does not control or advise on these terms and is not involved in the offering or acceptance of such terms.
  • Orderak may provide support services to Merchants for order fulfillment, payment collection, etc., based on independent contracts.

Non-Performance and Liability

  • Orderak is not responsible for any non-performance or breach of contract between Buyers and Merchants.
  • It does not guarantee transaction completion between Buyers and Merchants, nor is it responsible for unsatisfactory services, non-performance, damages, or delays due to out-of-stock items.

Role of Orderak

  • Orderak acts as a facilitator in the e-commerce platform and does not take possession of products or services offered by Merchants.
  • It holds no rights, title, or interest in products and has no obligations or liabilities in contracts between Buyers and Merchants.
  • Orderak is not responsible for the quality of goods provided by shops or restaurants, menu item availability, incorrect orders, or discrepancies in menu and price information.

Personal Information and Account Creation

  • Users need to provide personal information like name, phone number, and email address to create an account.
  • Additional demographic information and other profile details are optional.
  • Users are encouraged to be cautious about the information they share.

Order Delivery

  • Delivery times are approximate estimates and may vary.
  • Orderak is not responsible for delays due to processing or unavoidable circumstances.
  • Delivery is made to the address specified by the user at the time of order placement.
  • Orderak reserves the right to cancel orders or charge additional fees for changes in delivery location.
  • Users are responsible for providing clear delivery instructions and authorizations.

Liability and Risk

  • Once an order is delivered, all risk and responsibility pass to the user.
  • There will be no refund for failed deliveries due to user's failure to provide instructions or authorizations.

Payment Information

  • Users must provide accurate credit/debit card details to approved payment gateways.
  • Orderak does not share card details unless required for fraud verification or by law.
  • Users are responsible for the security and confidentiality of their card details.
  • Services are provided only during the working hours of relevant Merchants.


Orderak outlines specific activities that are prohibited on its platform. These include:

  1. Illegal Activities: Using the Websites for purposes that violate laws or regulations.
  2. Infringement of Rights: Posting content that infringes on intellectual property, privacy, publicity, trade secret rights, or any other rights of any party.
  3. Offensive Content: Posting content that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing as determined by Orderak.
  4. Cyber-bullying: Posting content that constitutes cyber-bullying.
  5. Risky Behavior: Posting content that depicts dangerous or life-threatening behavior.
  6. Personal Information: Posting private information like telephone numbers, street addresses, or last names without consent.
  7. External Links: Posting URLs to external websites or any form of HTML or programming code.
  8. Spam: Posting spam content.
  9. Impersonation: Impersonating another person.
  10. Harvesting Information: Collecting information about others without consent.
  11. Misuse of Identification: Allowing others to use your identification for posting or viewing comments.
  12. Harassment: Harassing, threatening, stalking, or abusing any person.
  13. Restrictive Behavior: Engaging in conduct that inhibits others' use of the Websites or exposes Orderak or others to liability or detriment.
  14. Encouragement of Prohibited Activities: Encouraging others to engage in prohibited activities.

Orderak reserves the right to take various actions against these prohibited activities, including removing content, terminating access, monitoring, editing, or disclosing any content on the Websites.


Orderak may modify or alter these Terms at any time by publishing changes on the Platform. Continued use of the Platforms after changes are published constitutes acceptance of the amended Terms.


Orderak may change payment methods at its discretion. Payments are processed by third-party providers, and with consent, payment information may be stored for future orders. Orderak is responsible for handling payments, refunds, chargebacks, cancellations, and dispute resolutions on its Platforms under reasonable and justifiable conditions.

Cancellation Policy

  • Orders can be canceled within 5 seconds of placement through the app.
  • After this window, cancellations must be made through the call center and are only accepted for quality issues or reasons beyond the customer's control.
  • Orders already prepared or in delivery cannot be canceled through the App; a phone call to customer service is required for such cancellations.


Refund Policy

Orderak's refund policy is structured as follows:

  1. Full Refunds for Quality Issues or External Factors: Customers receive a full refund on spoiled items if the cancellation is due to quality issues or reasons beyond their control.
  2. Partial Refunds After 5-Second Window: If a cancellation occurs after the 5-second window, a 30% partial refund is provided to cover food costs and delivery services.
  3. Refund Processing: Refunds are processed within 7 business days of cancellation approval and are issued to the customer's online wallet in the app.
  4. Cash Payment Refunds: Cash payments are refunded to the customer's wallet.

Customer Responsibilities

  • Prompt Cancellation Requests: Customers must submit cancellation requests promptly to be eligible for a full refund.
  • Accurate Order Information: Customers are responsible for providing accurate order details, including items, quantities, and addresses.
  • Return of Delivered Items: If an order has already been prepared or delivered, customers must return the items to the vendors.
  • Responsible Use of Refunded Funds: Customers should use refunded funds responsibly and not for unauthorized purposes.

Merchant Responsibilities

  • Efficient Cancellation Processing: Merchants are responsible for handling cancellation requests within the specified timeframe.
  • Order Verification: Accuracy of order information is verified before processing cancellations.
  • Timely Reimbursement: Merchants prioritize timely and accurate reimbursement to customers.
  • Clear Communication: Clear and transparent communication of cancellation policies on all platforms, including the app, website, and customer support materials.

Information Collection Methods

  1. Information from Web Browser:
    • Personal information such as name, contact number, mailing address, and email ID are collected.
    • The app fetches location information for better service.
    • Anonymous data like browser type, language, software and hardware attributes, visit time and date, IP address, and pages visited may be collected.
  2. Personal Information Provided by Users:
    • To create an account, users must provide identifiable information like name, phone number, and email address.
    • Demographic information such as zip code may be collected.
    • Users have the discretion to decide how much information to share in their profile.
    • Users are encouraged to carefully consider the information they share and are reminded to protect their identity and sensitive information.
    • Profiles can be reviewed and revised at any time.


Payment Information

For online payments on the Orderak platform, customers are required to provide financial details such as:

  • Bank Account Information
  • Mobile Financial Service (MFS) Details
  • Debit Card Information
  • Credit Card Information

Methods of Information Collection

  1. Session and Persistent Cookies:
    • Function: Cookies are used to make the website work efficiently and to track user interactions.
    • Types:
      • Session Cookies: These are deleted after closing the browser and help enable certain site features, understanding user interactions, and monitoring site usage.
      • Persistent Cookies: Remain on the user’s device for a set period and are used for repeat visits to the site.
  2. Web Beacons:
    • Used to track the effectiveness of communications.
  3. Advertising Cookies:
    • Used for serving relevant ads based on user interests (e.g., using Google ads services).
    • Help in limiting ad repetition and measuring ad effectiveness.
  4. Google Analytics:
    • Utilized for gathering statistical information about site visitors and their usage patterns.
    • Operates on an anonymous basis, without attempting to link anonymous data with personally identifiable information.
